DockNester Terms & Conditions for Customers

1. Purpose

These Terms & Conditions govern the relationship between DockNester ("we", "our", or "the Platform") and you ("Customer", "you", or "your") when booking boat charters via the DockNester platform.


2. Role of DockNester

DockNester is a marketplace platform that connects customers with independent charter providers ("Charter Partners"). DockNester does not own, operate, or manage any of the boats listed on the platform.

All charter services are provided and executed by independent Charter Partners. DockNester acts solely as an intermediary and is not a party to the service contract between you and the Charter Partner.


3. Booking Process

  • All bookings on DockNester are direct bookings and are immediately confirmed by the Charter Partner.
  • A booking is considered confirmed once your payment has been received and verified.
  • You will receive a booking confirmation email containing the reservation details.

4. Payment Terms

  • You must pay 50% of the total charter amount at the time of booking.
  • The remaining 50% is due 5 weeks before the start of the charter.
  • If your booking is made less than 5 weeks before the charter, the full amount is payable immediately.
  • If you fail to pay the remaining amount at least 4 weeks before the charter, your booking will be considered cancelled, and the cancellation policy will apply.

All payments are processed securely via Stripe.


5. Cancellations and Refunds

The following cancellation policy applies to all bookings:

  • 61 days or more before the charter: 70% refund
  • 31 to 60 days before the charter: 50% refund
  • 30 days or less before the charter: No refund

If a Charter Partner cancels your booking, you will receive a full refund. Refunds initiated by the Charter Partner for operational issues are the responsibility of the Partner.


6. Customer Responsibilities

By booking through DockNester, you agree to:

  • Provide accurate personal and crew details before departure
  • Respect the Charter Partner’s rules and instructions
  • Use the vessel responsibly and in accordance with local laws and navigation regulations
  • Return the vessel on time and in good condition

You are liable for any damage caused to the vessel or equipment due to misuse or negligence during your charter.


7. Limitation of Liability

DockNester shall not be held liable for:

  • Any loss, damage, injury, or delay occurring during the charter
  • Any operational failure, service issue, or safety problem related to the boat or its crew
  • Disputes between you and the Charter Partner
  • Force majeure events (e.g., severe weather, natural disasters, strikes)

The Charter Partner is solely responsible for executing the charter and ensuring vessel compliance, crew qualifications, and proper insurance coverage.


8. Insurance

Charter Partners are responsible for providing valid insurance coverage for the vessel and passengers. You are strongly advised to obtain additional travel or cancellation insurance to cover personal risk, unforeseen cancellations, or medical needs.


9. Data Protection

We are committed to protecting your data under the General Data Protection Regulation (GDPR).

  • We only share your personal data with the relevant Charter Partner for booking purposes.
  • Your data will not be sold or used for unrelated marketing.
  • You may request deletion or correction of your data at any time by contacting us at privacy@docknester.com.

10. Changes and Amendments

DockNester may modify these Terms at any time by providing 15 days’ notice on our website. Continued use of the platform after changes implies acceptance of the updated terms.


11. Governing Law and Disputes

These Terms are governed by the laws of Luxembourg.
Any disputes shall be subject to the exclusive jurisdiction of the courts in Luxembourg City.
